INTERN CRITERIA CHECKLIST:
鈽 The work is an integral part of the student鈥檚 course of study.
鈽 The student will receive credit for the work, or it is required for graduation.
鈽 The student must prepare a report of their experience for a faculty supervisor.
鈽 Written documentation from the school confirms sponsorship or approval of the internship.
鈽 Clearly identified learning objectives.
鈽 The student does not perform tasks that regular employees handle.
鈽 The student is in a shadowing/learning mode.
鈽 The employer provides an opportunity for the student to learn skills or business functions.
鈽 Educational value related to the student’s courses.
鈽 Supervision by a staff member.
鈽 Student does not provide benefit to the employer over 50% of the time.
鈽 No job guarantees upon completion of training or schooling.
As per the Fair Labor Standards Act (FLSA), the U.S. Department of Labor (DOL) has outlined six (6) criteria to identify a learner/trainee who may be unpaid:
鈽 Training is similar to that in a vocational school.
鈽 Training is for the benefit of the student.
鈽 The student works under close observation, not displacing regular employees.
鈽 The employer derives no immediate advantage from the student鈥檚 activities.
鈽 The student is not entitled to a job after training.
鈽 Both the employer and student understand that the student is not entitled to wages.
